TERMS AND CONDITIONS

1- ACCEPTANCE OF THE CONDITIONS

The customer acknowledges having read, at the time of placing the order, the general conditions of sale set out below and declares accepting them without reservation. The present general conditions of sale govern the contractual relations between DEEP ROOTS REGGAE SHOP and its customer, both parties accepting them without reservation. These general terms and conditions of sale shall prevail over any other terms and conditions contained in any other document, except in the case of prior, express and written derogation.

2- PRICES

DEEP ROOTS REGGAE SHOP reserves the right to modify its prices at any time, but the products will be invoiced on the basis of the rates in force at the time of the registration of the orders (subject to availability).

The products remain the property of DEEP ROOTS REGGAE SHOP until full payment of the order placed by the customer.

The prices of our products are indicated in Euros (€) including all taxes (T.T.C.) but excluding the processing and delivery costs. When ordering via the Internet, the total price indicated in the order confirmation includes the price of the products, the handling and packaging costs as well as the transport and commissioning costs.

In the event of delivery to a country other than metropolitan France, the recipient of the order will be considered the importer of the product(s) concerned. For all products shipped outside the European Union and French overseas departments and territories, the price will be calculated net of tax automatically on the invoice, customs duties or other local taxes or import duties or state taxes may be payable. These rights and taxes are not the responsibility of DEEP ROOTS REGGAE SHOP and will be charged to you. We advise you to inquire about these aspects with your local authorities.

The automatic recording systems communicated via the internet as well as the order forms sent by the customer by mail are considered as proof of the nature, content and date of the order. In the case of orders placed via the internet, DEEP ROOTS REGGAE SHOP confirms the acceptance of the order to the customer at the email address that the customer has provided.

DEEP ROOTS REGGAE SHOP reserves the right to cancel any order from a customer with whom there is a dispute over the payment of a previous order.

4 - AVAILABILITY

In the event of temporary unavailability of a product, DEEP ROOTS REGGAE SHOP reserves a period of 10 (ten) additional days for processing the order.

In the event that a product is permanently unavailable after you have placed your order, you will be informed by e-mail or telephone of the items in short supply:

• For a payment by Paypal, in case of unavailability of all or part of the order, the refund will be made by crediting the customer's Paypal account.
• For a payment by check, in case of unavailability of all or part of the order, the refund will be made at the choice of DEEP ROOTS REGGAE SHOP by bank transfer or by check within 15 (fifteen) days from the payment of the sums paid by the customer.
• For payment by bank transfer, in case of unavailability of all or part of the order, the refund will be made by bank transfer within 15 (fifteen) days from the payment of the sums paid by the customer.

5 - DELIVERY

The product(s) will be sent to the delivery address that the buyer will have indicated during the ordering process. In the event of an error in the recipient's details, the seller cannot be held responsible for the impossibility of delivering the product(s).

The delivery time depends on the postal service. Under no circumstances shall any delays give the buyer the right to claim damages.

Deliveries in France are made by La Poste as Colissimo or by Mondial Relay. Deliveries outside French territory do by La Poste (up to French customs) by courier, Colissimo or International Priority Package. In the event of apparent defects, the buyer has the right to return the goods under the conditions set out in this document.

6 - PAYMENT

The payment of the purchases is carried out according to the proposed solutions:

7 - SATISFIED OR REFUNDED

The buyer has a period of 7 (seven) days from the receipt of his order to return the product that does not suit him. Only the price of the product(s) purchased will be refunded.

Items returned incomplete or damaged or soiled by the Customer will not be accepted.

9 - RESPONSIBILITY

The products offered comply with current French legislation. DEEP ROOTS REGGAE SHOP shall not be held responsible for any failure to comply with the legislation of the country where the products are delivered (for example, in the event of a ban on a particular song). It is up to you to check with the local authorities the possibilities of importing or using the products or services that you plan to order.

The photographs reproduced and illustrating the products presented are non-contractual.

DEEP ROOTS REGGAE SHOP shall not be held responsible for the non-execution of the contract concluded in the event of force majeure, disruption or total or partial strike, in particular of the postal services and means of transport and/or communications, flooding or fire.
In the case of professional purchases, DEEP ROOTS REGGAE SHOP shall not be held liable for any indirect damage, operating loss, loss of profit, loss of opportunity, damage or costs.

10 - APPLICABLE LAW AND DISPUTES

In the event of a dispute, the customer shall first contact DEEP ROOTS REGGAE SHOP to obtain an amicable solution.

The present contract is subject to French law.
The language of this contract is English.
In the event of a dispute, the French courts shall have sole jurisdiction.

11 - PERSONAL INFORMATION

DEEP ROOTS REGGAE SHOP undertakes never to divulge to third parties the information you provide. This information is confidential. It will only be used to process your order and to reinforce and personalise the communication and the cultural and product offer reserved for DEEP ROOTS REGGAE SHOP customers. Consequently, in accordance with the French Data Protection Act of 6 January 1978 (France), you have the right to access, rectify and oppose any personal data concerning you. To do so, simply send us a request online or by mail, indicating your name, first name and address.
